Family-based immigration allows certain U.S. citizens and lawful permanent residents (green card holders) to bring or keep their loved ones in the U.S.A. Processes are established under law to provide for family unity when a qualifying relationship is demonstrated and required documentation is available.

The Most Common Forms Of Family-Based Immigration

These are the two main types of family-based immigration:

  • Immediate relatives (direct family members): This includes a U.S. citizen’s spouse and unmarried children under 21 years of age, and the parents of a U.S. citizen who is at least 21 years of age. Immediate relatives are prioritized under U.S. immigration law and are not part of the quota system limiting the number of annual visas, although government processing times are always involved.
  • Family preference relatives: This includes certain other family relationships with a qualifying U.S. citizen or lawful permanent resident petitioner. Family “preference categories” include unmarried adult sons and daughters of U.S. citizens, certain married children of U.S. citizens, unmarried spouses and children of lawful permanent residents, and siblings of U.S. citizens. Unlike immediate relatives, the family preference categories have limited numbers of annual visas, which generally result in longer wait times until an immigrant visa number is available.
